BUTLER - Two years ago Lieutenant Brian Pergande showed us how a new camera worked at the Butler Police Department. Now in 2014, a criminal complaint accuses him of using a camera for the wrong reasons. The Waukesha County District Attorney charged Pergande with misconduct.

The six page document claimed the Butler Officer went to a strip club in Milwaukee to arrest a dancer for outstanding municipal warrants back in 2009.

The complaint said the woman was escorted into a dressing room and Pergande remained there she took off all of her clothing to get dressed.

When they arrived at the police station the woman told investigator, Pergande took close up pictures of her covered breasts and claimed the images were “for the record.”

The Waukesha Sheriff’s Department found the images while investigating the former Butler Police Chief Michael Cosgrove. Cosgrove resigned in the midst of a scandal involving inappropriate acts, including pornography and racist and sexist slurs.

While looking into the chief, investigators found the images and linked them back to Pergande.  No one answered when TODAY’S TMJ4 stopped by Pergande’s house. But he did claim the photographs had been blown up and cropped. He said he didn’t recall taking the close up of the woman’s breasts.

The woman said she never reported it because she was concerned no one would believe her because she was a stripper.

Officer Pergande was already on leave and has filed a lawsuit against the village and the police department.  He claims he was retaliated against for complaining about the former chief.
