Fond du Lac County DA investigated for accepting strange plea deal

FOND DU LAC- The Fond du Lac County district attorney is under investigation after he allowed a man to plead no contest to a operating an aircraft under the influence -- even though no plane was involved.

To avoid losing his license, Larry Schreiber pled guilty to flying a plane while drunk, instead of driving while drunk.  And the fact the district attorney accepted this plea deal, has one Fond du Lac County woman so angry, the office of lawyer regulation is investigating.

Waupun resident Chrissy Ewerdt wrote to the office that investigates attorneys when she heard that District Attorney Daniel Kaminsky cut a plea deal with Schreiber.  "What he did was wrong.  It was an abuse of power," said Ewerdt.

Schreiber is the president of Anthem Blue Cross and Blue Shield of Wisconsin.

In the dash cam video, Schreiber was pulled over by the Fond du Lac County sheriff's department for drinking and driving in June, 2011.

"It was the first time in the history of this state that it has ever been used and the last because the DOT no longer allows that as an option," said Ewerdt.

So Ewerdt filed a complaint with the office of lawyer regulation.

They got back to her this week, saying they will investigate, something that office does in only 20 percent of complaints.

Kaminsky is out of town and did not respond to TODAY'S TMJ4's emails, but in an explanation on the county's website, Kaminsky said there were problems with the blood test, and that the penalties were the same.

As for Ewerdt, she says she just wants people to know what's going on, "I think he owes the public an apology."

Kaminsky now has until June 27 to respond to the investigation.
