1. PROMOTION DATES: The Businesses are looking UP with US Bank Contest (“Promotion”) will begin at 12:01am CT on June 25, 2012 and end on August 19, 2012 at 11:59pm CT.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all legal residents of the United States and the District of Columbia who are 18 years of age or older at the time of entry and who live in Wisconsin. Employees of Journal Broadcast Group (“Journal” or “Promoter”) and US BANK, their corporate parent, subsidiary, and affiliated entities, their advertising agencies, participating sponsors/promotional partners, other broadcasting stations in the Milwaukee Market, and the members of the immediate families (spouse, parents, siblings or children) or households of each of them are ineligible to participate or win. This Promotion is subject to all applicable federal, state, and local laws and regulations. Void outside the United States and where prohibited.
b. Only one winner per household is permitted in the Promotion.
c. The contest winner will be required to fill out Journal Broadcast Group’s prize claim form and present a valid form of photo ID.
d. Entrants are required to provide truthful information and Promoter will reject and delete any entry that it discovers to be false or fraudulent. Promoter will disqualify any entry from individuals who do not meet the eligibility requirements, and Promoter will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
e. Entrants must have the authority to enter the business that is the subject of the Entrant’s entry and entrants must confirm that they have such authority when entering the Promotion.
3. ENTRY
a. To participate in the Promotion, visit www.620wtmj.com or http://www.945lakefm.com and follow the links and instructions to enter and submit your first name and last name, the name of the business on whose behalf you are entering, your complete address, city, state, zip code, telephone number, date of birth and a valid email address in the online entry form. All businesses must operate within the 620 WTMJ AM listening area to be eligible to win.
b. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning the email address or the domain associated with the submitted email address. Multiple entrants are not permitted to share the same email address. All entries submitted become the sole property of the Promoter and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Promoter. The contest administrator’s computer is the official time keeping device for the Promotion. For purpose of this Promotion, a “Day” shall begin at 12:00:00 a.m CT and shall end at 11:59:59 p.m CT. Only one entry per person and one entry per email address are permitted.
4. PRIZES:
a. One Business Grand Prize: a radio advertising schedule for the Winning Business valued at $5,000.00 on WTMJ(AM). Advertising must be scheduled to run between November 12, 2012 and December 31, 2012.
b. One Charity Grand Prize: a radio advertising schedule valued at $5,000.00 on WTMJ(AM), to be given to one 501(c)3 charitable institutions, that is mutually agreed upon by WTMJ-AM and US BANK. (the “Winning Charity”): Advertising must be scheduled to run between November 12, 2012 and December 31, 2012.
c. All advertising scheduled pursuant to the Business Grand Prize and Charity Grand Prize will be scheduled at WTMJ(AM)’s then-current rate-card rates, is subject to WTMJ(AM)’s standard advertising terms and conditions and must be scheduled to air between November 12, 2012 and December 31, 2012. Any portion of either Grand Prize that has not been spent by December 31, 2012 shall be automatically forfeited without additional compensation. Such advertising is subject to availability and other restrictions may apply. No other prize will be substituted.
d. There is no substitution, transfer, or cash equivalent for either of the prizes, except that Promoter may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes or any other expenses, including, but not limited to, advertising production expenses. Other restrictions may apply.
e. Both the Winning Business and Winning Charity may only use their prize to promote their own goods or services, which must be done in a manner consistent with their prior advertising and promotion of those goods or services. Neither the Winning Business nor the Winning Charity may include any political messages or promote or criticize any third party entity in the advertising obtained through this Promotion.
f. Journal and WTMJ(AM) reserve the right to reject and refuse to broadcast any advertisement or other message proposed by the Winning Business or Winning Charity if Journal and/or WTMJ(AM) deems such advertisement or message unsuitable for broadcast or is not otherwise in the public interest in their sole discretion.
g. For purposes of clarification, the Entrant whose entry is selected as the winning entry shall not receive any prize or other compensation pursuant to this Promotion, other than (i) the benefit of having their Winning Business, and the Winning Charity chosen by the Winning Business, receive the prizes provided for herein, and (ii) the good will and positive benefit that will result to the entrant there from.
5 WINNER SELECTION AND NOTIFICATION
a. Decisions of Promoter management with respect to the Promotion are final.
b. One winning entry (“Winning Entry”) will be randomly selected by WTMJ-AM between August 19, 2012 and August 27, 2012.
c. The entrant who submitted the Winning Entry must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of notification attempt or winner will be disqualified and the prize will be forfeited and an alternate winner may be chosen by US Bank based on the criteria listed above. If a potential winner cannot be contacted, fails to complete, sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner will be disqualified and will forfeit the prize.
d. Following the selection of the Winning Entry by US Bank, Promoter will attempt to contact the business designated by the entrant in the Winning Entry to confirm that the business would like to accept the Business Grand Prize. An authorized representative of the business designated on the Winning Entry must execute and return any required acceptance agreement and/or liability/publicity release within ten (10) days of notification attempt or the Winning Entry will be disqualified, all prizes will be forfeited, and an alternate winner may be chosen by US Bank based on the criteria listed above. If an authorized representative of the business designated on the Winning Entry correctly executes and returns the acceptance agreement and/or liability/publicity release within the ten (10) day period, that designated business shall be the “Winning Business”. The Winning Business shall designate on the required acceptance agreement which of the charitable organizations listed above shall be offered the Charity Grand Prize.
e. In order to claim the Charity Grand Prize, the charitable organization designated by the Winning Business must execute an acceptance agreement and/or liability/publicity release form and return it to the Promoter, making it the “Charity Winner”
f. Unless otherwise specified in the prize notification, all prizes or prize certificates may be picked up at the office of the Promoter at the address below. The winner will forfeit any prize or prize certificate not claimed within thirty (30) days of winning. Prize or prize certificates will not be mailed to the winner without the winner’s prior written consent in which the winner shall agree to assume its risk of loss. The Promoter, its sponsor, or promotional partners are not responsible for the safe arrival of a prize or prize certificate.
6. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners, Winning Business and or Winning Charity. Winners, the Winning Business and the Winning Charity will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by Promoter in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.
b. By participating in the Promotion, each winner agrees, and by accepting a prize, each Winning Business and Winning Charity agrees, to have his, her, or its name, city, state, voice, or likeness used in any advertising or broadcasting material relating to this Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the contest, the Promoter in its sole discretion will require verification of Promotion winner’s identification or the identification of any individual executing any document on behalf of the Winning Business or Winning Charity by a showing of valid government-issued photo identification. By participating in the Promotion, each winner agrees, and by accepting a prize, each Winning Business and Winning Charity agrees, to release hold Promoter, its sponsor(s) and promotional partner(s), and each of their parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents and representatives of each of them (collectively, the “Released Parties”) harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion.
d. Promoter, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of Promoter’s web channel or is otherwise in violation of the rules. Promoter further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Promoter’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by Promoter in is sole discretion. Any attempt by an entrant or any person to deliberately damage any Promoter web channel or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws. Should such an attempt be made, Promoter reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of Promoter, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, Promoter reserves the right, but not the obligation, to modify, suspend or cancel the Promotion and shall not be required to award a substitute prize.
e. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or (iii) lost, stolen, mangled, misdelivered, postage due, illegible, incomplete, incorrect, or late entries.
f. To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winner List” to The Businesses are looking UP with US Bank Contest or Official Rules Request, WTMJ-AM 720 E Capitol Dr. Milwaukee, WI 53212. A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at WTMJ-AM 720 E Capitol Dr. Milwaukee, WI 53212. All such requests must be received within thirty (30) days following completion of the Promotion.
