Under the Influence: Nichole Brosky

Meet 30 year old Nichole Brosky.

Police say the West Allis woman got in crash with her five children in the car. As police responded they discovered that Brosky was intoxicated. She blew a .14 on the breathalyzer and failed field sobriety tests.  Oh yeah, she also gave a false name to police.

She is now charged with OWI-2nd.

Her first offense wasn't even a crime.  Wisconsin is the only state where first time OWI is not a crime.  Maybe if she had been convicted of a crime the first time, Brosky would have learned her lesson. Maybe it would have scared the heck out of her and she would have gotten the message.  Maybe it would have led to turning her life around.  Maybe she wouldn't have put her kids at risk. We'll never know because the first time Brosky got caught drinking and driving she wasn't even charged with a crime.

This has got to change.
